TERMS AND CONDITIONS
All passes and pass packs are valid for 6 months unless described otherwise. No refunds or extensions are granted on six-monthly class packs; however, in genuine cases of hardship or medical necessity the balance of the pass may be gifted to another person.
Unlimited class membership options do not include any private sessions or 4:1 small group priced services.
The minimum term for a weekly debited membership is eight weeks.
If you wish to cancel your weekly debit membership 7 days’ notice is required to process terminations.
Weekly debited and the 6-month Unlimited Pass can be paused up to 8 weeks each year, with a 7-day notice period prior to pausing. We may agree to suspend your membership for more than the period noted for medical or hardship reasons but supporting documentation (e.g medical certificate) must be provided to our reasonable satisfaction.
Bodyfit by Holly May is in no way responsible for the safekeeping of your personal property brought on to the premises of Bodyfit by Holly May is, nor shall Bodyfit by Holly May is be held liable for any loss, theft or damage to, your personal property for any reason.
Every possible effort is made to deliver our Programs on time as advertised. However, timetables are subject to change or cancellation without notice. While Bodyfit by Holly May will endeavour to provide as much notification as possible if this occurs, we are not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.
Bodyfit by Holly May reserves the right to increase its prices (including membership pricing) from time-to-time and offer additional pricing options.
All purchases are final. Bodyfit by Holly May does not offer refunds on its programs for change of mind, injury, illness, change of address or any other reason unless required by Australian Consumer Law. Purchases may be transferred to other persons upon request.
Passes and memberships may not be shared unless authorised by Bodyfit by Holly May in its sole discretion. Gift vouchers are not redeemable for cash.
1. By booking into a Bodyfit by Holly May program, you agree to our WAITLIST AND CANCELLATION POLICY:
a) Please confirm or cancel your booking 6 hours prior to the class commencing. You must process a cancellation through the online booking system only. Bodyfit will not accept class cancellations by email, SMS or social media. By doing so this allows other members of the community to secure a spot in the class and ensures the instructors can plan accordingly for everyone. If you wish to discuss a cancellation after the cancellation has been processed, please contact us by email or via the bodyfit app and we will assist you from there.
b) You agree that your class fee (or pass available for that class) shall be forfeited in the event you do not give the required 6 hours’ notice of cancellation. If you are a member on a direct debit payment arrangement, cancellations within 6 hours’ notice will incur a $10 cancellation fee, NO-SHOWS to class will incur a $15 cancellation fee and you agree to pay this fee. Cancellations within 30-minutes of the class commencing is considered a No-Show & will be charged as one. Weekly members & clients on our ‘New Client Intro Pass’ will receive one late fee waived per calendar month.
c) If you are on the waitlist, a text or email will be sent if you secure a spot in the class. Waitlist confirmation assumes attendance unless declined within 6-hours of the class starting. The waitlist will not activate between the hours of 11pm and 5am each night.
d) If you are on the waitlist & within 60-minutes of the class commencing a space becomes available you will receive a text message along with others on the waitlist. Whoever responds first will secure the booking, always await a confirmation email/text prior to arriving to class to avoid disappointment
e) It is a client’s responsibility to manage their bookings and monitor waitlists. During a suspension, clients need to cancel any pre-booked bookings/classes during the suspension period to avoid incorrect charges for not attending.
f) Late arrivals: If you are more than 5 minutes late, unfortunately you will not be permitted entry into the class, and your class credit will be forfeited.
2. You acknowledge that a Bodyfit by Holly May staff are not medically trained and are not qualified to assess if you are in good physical condition and can exercise or undertake nutritional programs without risking your health, safety or comfort. You further acknowledge and agree that any dietary or nutritional advice, or physical fitness advice, courses or programs provided by a Bodyfit by Holly May are for informational and educational purposes only and that you should speak with your doctor or other healthcare professional before acting on any such information or commencing any new dietary regime. a Bodyfit by Holly May dietary programs may not be suitable to your particular circumstances.
3. By booking into any Bodyfit by Holly May Programs you confirm that you are not pregnant, injured or suffer from a medical condition, or that you have supplied a medical certificate to state that you are fit to attend any Programs offered by a Bodyfit by Holly May and have discussed your medical condition or pregnancy with your a Bodyfit by Holly May instructor/s prior to your participation in the Program.
4. You agree to enter and use all the facilities at a Bodyfit by Holly May entirely at your own risk. You acknowledge that the activity you may undertake in our Programs is at times a strenuous activity and by participating in it you are exposed to certain risks including injury, or loss or damage to personal property.
5. Not withstanding any limitations or restrictions placed on this agreement under the Australian Consumer Law, you acknowledge and agree that a Bodyfit by Holly May shall not have any responsibility or liability to you in respect of any loss or damages you may suffer, directly or indirectly, in connection with your attendance at or participation in a Bodyfit by Holly May Programs. You further agree to defend, indemnify, and hold a Bodyfit by Holly May its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt or expenses (including but not limited to solicitor’s fees) which may be suffered by it or them in connection with your participation a Bodyfit by Holly May Programs.
6. The collection, use, storage and limited disclosure of personal information (and any associated health information) is subject to a Bodyfit by Holly May’s Privacy Policy. You confirm that you consent to the terms of a Bodyfit by Holly May Privacy Policy.
7. Weekly Auto-Pay Memberships
a) The minimum term for a weekly membership is eight weeks.
b) After eight weeks, the membership will automatically continue on a weekly basis until Bodyfit by Holly May is advised by you via email (hello@bodyfitbyhollymay.au) or via the bodyfit app to terminate the membership. At least seven (7) days’ notice is required to process membership terminations. All pre-booked classes and/or re-occurring bookings will be cancelled after termination is made effective unless requested otherwise. Reinstatement of memberships will not be granted within six months of cancellation.
c) Membership fees will be charged to your credit card or bank account once per week via a third party biller.
d) Upgrading or downgrading of memberships are possible with 7-days’ notice after the 8-week commitment has been complete.
e) It is your responsibility to ensure there are sufficient funds available to cover the weekly auto-debit. If an auto-debit is declined due to insufficient funds, the transaction will fail which requires additional administration and may yields additional bank costs.
Bodyfit by Holly May reserves the right to charge a $10 administration fee if an auto-debit fails three (3) times or more.
f) Bodyfit by Holly May is in no way responsible for additional bank fees that you may incur from your bank.
g) Bank fees are under the terms and conditions of contractual agreements that lie between you and your bank.
h) If an auto debit cannot be made for any reason, Bodyfit by Holly May may in its absolute discretion, process payment anytime after the due date upon receipt of sufficient monies in your account.
i) After the minimum term of eight weeks, memberships may be suspended via a written request (via email or through the bodyfit app) for a minimum of one (1) week and a maximum of eight (8) weeks (or by negotiation). Verbal requests to staff or instructors will not be recognised. Suspensions must be made in weekly increments only. I.e. 1 week, 2 weeks, 3 weeks, up to 8 weeks. Bodyfit by Holly May cannot pro-rate day usage. Seven days’ notice prior to the suspension date request is required to process the suspension. Cancellations/suspensions of memberships are not effective until you have received written confirmation from the studio team.
j) Class Cancellations are subject to our Cancellation Policy.
k) If auto-debit payments fail for four weeks or more, Bodyfit by Holly May may in its absolute discretion cancel the membership.
l) The terms and conditions and our third party biller agreement form a binding component of your membership agreement. In addition to being provided to you at sign-up, these terms and conditions can also be found at Bodyfitbyhollymay.com/terms-and-conditions
m) Memberships may not be shared unless authorised by Bodyfit by Holly May in its sole discretion.
8. Bodyfit by Holly May reserves the right to restrict the availability of certain Programs to Weekly or 6 Month Unlimited Membership holders in its sole discretion.
